A federal judge presiding over an antitrust case involving Elon Musk’s companies, Apple and OpenAI has requested settlement documents that may explain why X Corp and SpaceXAI dropped their claims against Apple on Tuesday, POLITICO reported.
On Wednesday, Judge Mark Pittman, a conservative Trump appointee serving in Fort Worth, Texas, directed the Musk-owned companies to submit any agreements with Apple connected to the decision to dismiss the claims for his review.
The order follows OpenAI’s effort to force X to reveal information about its settlement with Apple in the dispute over control of the potentially trillion-dollar artificial intelligence market.
The voluntary dismissal motion was submitted without an explanation and stated that X and SpaceXAI would continue pursuing antitrust claims against OpenAI.
The lawsuit claims that Apple and OpenAI are “two monopolists joining forces to ensure their continued dominance” in the AI sector, including through alleged manipulation of rankings in Apple’s app store.
The complaint also cites an exclusive 2024 agreement to add OpenAI’s ChatGPT to Apple’s widely used iPhone. Apple has reportedly entered into a new agreement this year to incorporate Google’s AI services into its products.
